Following an arrest, an accused person will generally have an opportunity to seek release from custody through a bail hearing.

Individuals searching for a Calgary bail hearing lawyer are often doing so during one of the most stressful moments of their lives. Whether the arrest occurred in Calgary, Airdrie, Chestermere, Cochrane, Okotoks, or elsewhere in Alberta, understanding how bail hearings work is often the first step toward securing release from custody.

In Canada, being charged with a criminal offence does not automatically mean a person will remain in custody until trial. In many cases, the police may release an accused person directly from the police station. Where police do not release the accused, the matter will typically proceed before a justice or judge who will determine whether release is appropriate.

A bail hearing, sometimes referred to as a judicial interim release hearing or show cause hearing, is the court proceeding where that decision is made.

The purpose of the hearing is not to determine whether the accused person is guilty. The court is not conducting a trial, hearing witness testimony, or deciding whether the allegations are true. Instead, the court must decide whether the accused should be released while the criminal charges continue through the court process and, if so, what conditions should be imposed.

For many accused persons facing criminal charges in Calgary and throughout Alberta, the bail hearing is the first and most important court appearance in the case. A successful bail application may allow an accused person to return home, continue working, support their family, and meaningfully participate in preparing their defence while awaiting trial.

Conversely, where bail is denied, an accused person may remain in custody for weeks, months, or even longer while the criminal matter proceeds through the courts.

For that reason, understanding how bail hearings work, what courts consider, and how a proper bail plan is prepared is often critically important following an arrest.

The Ladder Principle: Why Release Is The Starting Point

Although the law surrounding bail can appear complicated, one of the most important principles remains surprisingly simple. Canadian courts are generally expected to begin with the least restrictive form of release and only move toward more restrictive forms of release where the circumstances justify doing so.

This concept is known as the ladder principle. Simply because an accused person has been charged with a criminal offence does not automatically justify house arrest, cash bail, a surety, or numerous restrictive conditions.

Instead, courts are expected to work up the "ladder" of increasingly restrictive forms of release. For example, the court may first consider whether an accused person can be released without any restrictive conditions. If further concerns remain, the court may consider additional conditions such as reporting requirements, curfews, house arrest, or other restrictions. Detention should generally be considered only where less restrictive alternatives cannot adequately address the court's concerns.

For Calgary criminal defence lawyers, the ladder principle is often one of the most important protections available during a bail hearing. It requires the Crown to justify why a more restrictive form of release is necessary rather than simply asking for the most onerous conditions available.

In practical terms, the greater the concerns regarding attendance in court, public safety, or confidence in the administration of justice, the further up the ladder the court may be prepared to go. Conversely, where those concerns can be adequately managed through less restrictive measures, the law generally favours release over detention.

When deciding whether an accused person should be released, the court considers three broad concerns: whether the accused will attend future court appearances, whether release would create an unacceptable risk to public safety, and whether release would undermine public confidence in the administration of justice.

The first concern is often referred to as the primary ground. Courts examine factors such as the accused person's ties to the community, employment, family support, housing stability, and past attendance history. The question is simple: if released, is the accused likely to return to court as required?

The second concern is known as the secondary ground and is frequently the central issue in contested bail hearings. The court considers whether release would create a substantial likelihood of further offending, interference with witnesses, interference with the administration of justice, or other risks to public safety. Allegations involving violence, domestic violence, weapons, drug trafficking, or repeat offending often receive particular scrutiny under this ground.

The third concern is the tertiary ground, which focuses on maintaining public confidence in the justice system. In serious cases involving significant violence, firearms, home invasions, serious sexual offences, or other allegations carrying substantial penalties, the court must consider whether release would cause a reasonable member of the public to lose confidence in the administration of justice.

Importantly, these concerns do not automatically prevent release. The court must assess the specific circumstances of each case and determine whether any identified risks can be adequately managed through appropriate release conditions, supervision, sureties, treatment programs, no-contact orders, curfews, or other safeguards. Where the risks can be effectively addressed, release will often remain appropriate despite the seriousness of the allegations.

This is why a well-prepared bail plan is often the most important part of a bail hearing. The stronger the proposed plan for addressing attendance concerns, public safety concerns, and public confidence concerns, the greater the likelihood that release will be granted.

What Is Reverse Onus Bail?

In most bail hearings, the Crown bears the burden of proving why detention is necessary. However, certain situations trigger what is known as a reverse onus hearing, where the burden shifts to the accused person to demonstrate why release is appropriate and why any concerns can be adequately managed in the community.

Reverse onus provisions commonly apply in cases involving certain firearm offences, offences allegedly committed while already on release, certain intimate partner violence matters involving prior convictions, repeat violent offending, allegations involving strangulation, certain home invasion offences, certain human trafficking offences, violent extortion offences, and other offences specifically designated by Parliament.

 

One misconception is that a bail on "reverse onus" means bail is impossible. This is not correct. Individuals continue to obtain bail in reverse onus cases every day. However, because the burden shifts to the accused, courts will often expect a stronger bail plan, suitable sureties, stable housing arrangements, and proposed conditions that directly address the concerns raised by the Crown. As a result, preparation is often particularly important in reverse onus bail hearings.

Courts want practical answers to practical concerns. Even where concerns arise under the primary, secondary, or tertiary grounds for detention, the court must determine whether those concerns can be adequately managed through a structured release plan.

A stronger bail plan might involve the accused residing with family, having no contact with the complainant, continuing employment, and being supervised by a responsible surety. These proposed conditions directly address the concerns raised by the Crown.

Whether the matter involves assault charges, domestic violence allegations, weapons offences, drug offences, or other criminal charges in Calgary, the proposed release plan should address the specific concerns raised by the allegations and the accused person's circumstances.
