Avoiding a Criminal Record and Other Non-Custodial Outcomes

A criminal charge does not necessarily result in a criminal conviction. Depending on the circumstances, the evidence, the accused person’s background, and the position taken by the Crown, there may be opportunities to resolve a case without a criminal conviction. These outcomes can include withdrawal of charges, a peace bond, diversion or alternative measures where available, or a discharge after a finding of guilt.
A conditional discharge allows a person to be found guilty without a conviction being registered, provided the court is satisfied that granting the discharge is in the person’s best interests and is not contrary to the public interest. Conditions are generally imposed for a period of probation, and successful completion of those conditions can avoid a permanent criminal conviction.
