In May 2026, the Supreme Court of Canada released its landmark decision in Ahluwalia v. Ahluwalia, 2026 SCC 16, recognizing a new tort of intimate partner violence. This is one of the most significant recent developments in Canadian family and civil law.
For many years, victims of family violence generally relied on traditional claims such as assault, battery, or intentional infliction of emotional distress. The Supreme Court recognized that these legal remedies do not always reflect the reality of abuse within intimate relationships, particularly where the abuse consists of years of coercion, control, intimidation, and manipulation rather than a single incident.
For individuals going through a Calgary divorce or separation, the decision may create legal remedies that extend beyond parenting disputes, support claims, or property division.

Domestic Violence Is Not Limited to Physical Abuse

Many people assume that domestic violence only exists where there are visible injuries or police involvement. In reality, family violence can take many forms.
Examples may include controlling household finances, restricting access to money, monitoring communications, isolating a partner from family and friends, threatening immigration consequences, interfering with employment, using children as leverage, or engaging in repeated intimidation and humiliation.
While these behaviours may not leave physical injuries, they can have serious emotional, financial, and psychological consequences. Courts increasingly recognize that a pattern of controlling behaviour can be just as harmful as physical violence.

What Is Coercive Control?

Coercive control is a central concept in the Supreme Court's 2026 Ahluwalia decision.
Rather than focusing on a single incident, coercive control refers to a pattern of conduct designed to dominate, intimidate, or control another person within an intimate relationship.
Examples may include financial control, surveillance, threats, social isolation, interference with employment, repeated intimidation, or conduct that causes a partner to lose their ability to make independent decisions.
The Supreme Court recognized that the harm caused by coercive control often results from the cumulative pattern of behaviour rather than any single event.

Can You Sue a Spouse for Domestic Violence?

Potentially, yes.
The significance of Ahluwalia v. Ahluwalia is that the Supreme Court of Canada formally recognized a new tort of intimate partner violence.
The Court acknowledged that many victims experience abuse through ongoing patterns of domination, threats, isolation, financial control, surveillance, and psychological manipulation. In some cases, the overall impact of these behaviours may be more significant than any individual incident.
The decision represents a major development because it allows courts to examine the overall pattern of abusive conduct rather than requiring victims to separate their experiences into multiple individual legal claims.
Every case remains fact-specific and will depend on the available evidence. However, the 2026 Ahluwalia decision provides a clearer legal framework for victims seeking compensation arising from sustained coercive and controlling conduct.

Evidence and Early Legal Advice Matter

In family violence cases, evidence is often critical.
Text messages, emails, financial records, bank statements, photographs, medical records, counselling records, witness testimony, social media communications, and court documents may all become important evidence. Courts frequently examine the overall pattern of conduct rather than focusing on a single incident. As a result, records showing ongoing control, intimidation, threats, isolation, or coercive behaviour may carry significant weight.
Family violence can also affect many aspects of a family law case, including parenting arrangements, decision-making responsibility, parenting time, Emergency Protection Orders, exclusive possession applications, child support, spousal support, and property division.
Because the same evidence may become relevant across multiple legal issues, preserving documentation early can be extremely important. Obtaining legal advice at an early stage may help protect evidence, identify potential claims, and ensure important issues are addressed from the outset.
