Being served with an Emergency Protection Order ("EPO") in Alberta can be overwhelming. An EPO may require a person to leave their home immediately, prohibit contact with a spouse, partner, or family member, and create significant consequences for future family court proceedings.
Many people assume that once an Emergency Protection Order has been granted, the outcome is already decided. That is not the case.
Emergency Protection Orders are governed by Alberta's Protection Against Family Violence Act ("PAFVA"). Although an EPO may initially be granted without notice to the respondent, every EPO must later be reviewed by the Court of King's Bench. At that review hearing, the Court may revoke the order, direct an oral hearing, confirm the order, or replace it with another form of protection order.
Understanding how the review process works is often critical to protecting your rights.

Can an Emergency Protection Order Be Cancelled?

Yes.
An Emergency Protection Order is not automatically permanent simply because it was granted at the initial application stage. Under Alberta law, every EPO must be reviewed by the Court of King's Bench shortly after it is granted.
At the review hearing, the Court examines the evidence and determines whether the statutory requirements continue to justify the protection granted. Depending on the circumstances, the Court may revoke the order entirely, vary its terms, direct a further oral hearing, confirm the order, or replace it with another form of protection order.
For many respondents, the review hearing is the most important stage of the process because it provides the first meaningful opportunity to challenge the allegations and present evidence to the Court.
緊急保護令(EPO)可以被撤銷嗎?

What Are the Legal Grounds for an Emergency Protection Order in Alberta?

One of the most common misconceptions about Emergency Protection Orders is that they are automatically granted whenever a relationship breaks down or a serious argument occurs. That is not the law.
Under Alberta's Protection Against Family Violence Act, an Emergency Protection Order may only be granted where the Court is satisfied that family violence has occurred, that the claimant has reason to believe the family violence will continue or resume, and that immediate protection is required because of the seriousness or urgency of the circumstances.
The legislation defines "family violence" broadly and may include physical violence causing injury, threats that create a reasonable fear of injury or property damage, property damage intended to intimidate or harm a family member, forced confinement, sexual abuse, and stalking. In determining whether an Emergency Protection Order should be granted or confirmed, the Court may also consider the history of family violence between the parties, whether the alleged conduct is repetitive or escalating, the existence of any immediate danger, the impact of the alleged conduct on children, and the claimant's need for a safe environment while arranging longer-term protection.
These legal requirements are important because they often become the focus of a successful defence. Many respondents assume they must prove every allegation is false. In practice, the more important question is often whether the claimant has established all of the statutory requirements under PAFVA. Even where a disagreement, argument, or isolated incident occurred, the Court must still determine whether the evidence demonstrates family violence, a continuing risk of future harm, and the urgency necessary to justify immediate protection.

How to Fight an Emergency Protection Order in Alberta

Every case depends on its own facts. However, successful challenges to Emergency Protection Orders often focus on whether the alleged conduct constitutes family violence under PAFVA, whether there is sufficient evidence supporting the allegations, whether there is a genuine risk that family violence will continue or resume, and whether the circumstances demonstrate the seriousness or urgency required by the legislation.
Importantly, Alberta courts do not automatically confirm every Emergency Protection Order. In T.P. v. J.P., 2005 ABQB 529, the Court revoked an Emergency Protection Order after finding that the evidence did not establish family violence and that the circumstances lacked the urgency normally required for immediate protection.
The decision illustrates an important principle: allegations alone are not enough. The Court must ultimately determine whether the evidence satisfies the statutory requirements before an Emergency Protection Order will be confirmed.

What Evidence Can Help Defend an EPO?

The strongest EPO defences are usually evidence-based rather than argument-based. Depending on the circumstances, relevant evidence may include text messages, WeChat conversations, emails, photographs, witness statements, police occurrence reports, medical records, parenting schedules, call logs, and detailed timelines. Evidence showing the parties' conduct before and after the alleged incident may be particularly important.
Many respondents focus exclusively on denying the allegations. In practice, courts are often more interested in objective evidence demonstrating what actually occurred. A carefully prepared timeline supported by documentary evidence is frequently more persuasive than general denials, particularly where credibility becomes an issue.

What Happens at an EPO Review Hearing?

At the review hearing, the Court reviews the materials supporting the original Emergency Protection Order and may permit additional evidence to be presented. The Court's role is not simply to rubber-stamp the original decision. Rather, it must independently determine whether the statutory requirements under the Protection Against Family Violence Act continue to justify the order.
The review process provides respondents with an opportunity to challenge the allegations and present their own evidence. In Echeverria v. Morales, 2007 ABQB 293, the respondent actively opposed confirmation of the Emergency Protection Order by filing affidavit evidence, disputing allegations of intimidation and family violence, offering an alternative explanation for the events in question, and relying on corroborative evidence from another witness. Although the Court ultimately confirmed the order, it described the matter as a "borderline case" after considering the competing evidence presented by both parties.
The decision illustrates that EPO review hearings are not automatic and that respondents are entitled to meaningfully contest whether the statutory requirements have been established. A well-prepared respondent may be able to identify weaknesses in the claimant's evidence, challenge the credibility of the allegations, and argue that continued protection is not warranted. Depending on the circumstances and the evidence before it, the Court may revoke the order, confirm the order, direct that an oral hearing be held, or replace the order with another form of protection order.

What Should You Do If You Have Been Served With an EPO?

If you have been served with an Emergency Protection Order, the first and most important step is to comply strictly with its terms. Do not attend prohibited locations, contact protected persons, or attempt indirect communication through friends, family members, or social media. Breaching an Emergency Protection Order may result in additional legal consequences that are separate from the original allegations.
It is also important to understand that the consequences of an EPO often extend beyond the initial review hearing. Emergency Protection Orders frequently arise alongside divorce proceedings, parenting disputes, child custody matters, and disputes concerning possession of the family home. Although an EPO review hearing is separate from a divorce or parenting application, the allegations and evidence presented during the EPO process may become relevant in later proceedings. An EPO can affect parenting arrangements, decision-making responsibility, exclusive possession applications, child support disputes, and the Court's overall assessment of credibility.
For these reasons, respondents should take EPO proceedings seriously even where they believe the allegations are exaggerated, inaccurate, or incomplete. The next step is to begin preserving evidence immediately. Text messages, emails, WeChat communications, photographs, call records, witness information, and any other potentially relevant evidence should be gathered and preserved as early as possible.
Obtaining legal advice at an early stage is often beneficial. The period immediately following service is frequently the most important stage of the process because evidence is easier to preserve, witnesses' memories are fresher, and strategic decisions made at the outset can significantly affect the outcome of the review hearing and any related family law proceedings.
