For many people, the family home becomes the biggest battle after separation. In Calgary divorces and relationship breakdowns, disputes over the house are rarely just about property. They often involve parenting, finances, stability, and control over what happens next. One person may want to keep the home while the other wants it sold immediately. Others disagree over down payments, mortgage payments, renovations, family gifts, or who contributed more during the relationship. What many people discover very quickly is that the answer is rarely simple.

Under Alberta’s Family Property Act (“FPA”), the court has broad authority to divide family property in a manner that is considered “just and equitable.” The law applies not only to married spouses, but also in many cases to Adult Interdependent Partners (“AIPs”). The court may examine financial contributions, parenting arrangements, exempt property claims, and the overall financial position of both parties.

One of the most common misunderstandings in Calgary family law is the belief that being on title automatically means keeping the home. That is not always true. Even where only one spouse or partner is listed on title, the other person may still have significant legal claims involving the family home depending on the relationship history and financial contributions made during the relationship.

Courts may examine mortgage payments, renovations, shared finances, family gifts, and contributions made as a homemaker or parent. The FPA specifically requires the court to consider both direct and indirect contributions to the acquisition, preservation, or improvement of property.

Many family home disputes involve arguments over exempt property. Under the FPA, certain property owned before marriage or before the relationship began may receive exempt treatment, including inheritances, gifts from third parties, and pre-relationship assets. However, that does not automatically mean the entire present-day value of the property remains exempt.

In many Calgary divorce cases, exempt funds later become mixed into the relationship financially. A parent may contribute toward the down payment. One spouse may own the home before marriage. The mortgage may later be refinanced jointly, or renovations may be funded using shared income. Over time, tracing what remains exempt can become extremely complicated.

The court may also examine increases in property value during the relationship, including appreciation connected to mortgage reduction, renovations, or market growth. These disputes often depend heavily on financial records, disclosure, and credibility evidence.

Can the Court Order Unequal Distribution?

Potentially, yes.

Although Alberta family law often begins with the idea of equal division, the FPA allows the court to divide property unequally where equal division would not be considered “just and equitable.” When making these decisions, courts may consider the financial positions of both parties, contributions made during the relationship, the duration of the relationship, whether property was acquired after separation, whether assets were dissipated or hidden, prior agreements between the parties, and any other circumstances the court considers relevant.

 

Unequal distribution arguments often arise where one party claims significant exempt property, where parents or family members funded the home purchase, where one person wasted or transferred assets improperly, or where financial contributions during the relationship were heavily disproportionate. These disputes are highly fact-specific and often become some of the most contested financial issues in Alberta family law proceedings.

Can One Person Stay in the Home During the Dispute?

In some situations, yes.

The court may grant exclusive possession of the family home on a temporary basis, including orders requiring one party to leave the property. When making these decisions, courts may consider the needs of children, the financial circumstances of the parties, available alternative housing, and existing court orders.

This commonly arises during high-conflict separations involving parenting disputes, Emergency Protection Orders (“EPOs”), or allegations of family violence. Many people mistakenly assume leaving the home means automatically giving up ownership rights. That is not necessarily true. However, emotional decisions made early in the separation often create serious legal and financial consequences later.

Many people make major mistakes during the first weeks after separation. Some stop paying the mortgage emotionally. Others transfer money impulsively, remove property from the home, or rely on informal verbal agreements that later become difficult to prove.

The FPA also allows courts to address situations where property is transferred, hidden, dissipated, or gifted away to defeat the other party’s claims. In serious cases, the court may restrain transfers, unwind transactions, or account for dissipated assets during property division.

Family home disputes can affect property division, parenting arrangements, support obligations, mortgage liability, and long-term financial stability for years after separation. What happens early in the process often matters far more than people realise.
